Ontario Government Continuing to Fight for Rights of Motorists


    Province Considering Course of Action And Impact on Motorists 

    TORONTO, Nov. 7 /CNW/ - The Ontario government is reviewing the
November 7, 2005, judicial decision compelling the Registrar of Motor Vehicles
to refuse to validate or issue vehicle permits for those persons who have
failed to pay tolls and administrative fees owed to 407 ETR, Transportation
Minister Harinder Takhar said today.
    "We are disappointed with this decision," said Takhar. "Denying someone
the right to renew their license plate significantly affects their ability to
drive, and that is very serious. It's even more serious when it occurs through
no fault of their own, but because the 407 ETR electronic system made a
mistake.
    The province is reviewing this decision to determine the next course of
action, including appeal. As part of this review, the province will consider
if a stay of the decision should be pursued to ensure no plates are denied
before an appeal is heard.
    The province and 407 ETR agreed in February 2000 that plate denial would
be suspended until 407 ETR's systems were working properly. 407 ETR launched a
judicial review on July 23, 2004, calling for the Registrar to immediately
enforce plate denial.
    There continues to be other legal proceedings between the company and the
Ontario government. The government is making every effort to ensure that 407
ETR is complying with the 99-year agreement. With another 93 years left, the
province will continue its efforts to use every means available under the
contract to protect the public interest.
